1. You are eligible to enter if:
i. You (“Entrant”) are a permanent resident of Australia.
ii. You are 13 years old or older as of the date of entry. If Entrants are under 18 years of age you confirm you have obtained the consent of your parent/guardian.
iii. You submit a valid entry and provide us with complete and accurate registration information.
iv. You allow Latitude Group Travel to use your image in any digital/printed promotional materials/marketing. (We can tag your Facebook or Instagram account if you wish – if you provide us with your social media handle).
v. Please do not submit any photographs or content that is/are obscene, vulgar, pornographic, hateful, threatening, racist, sexist, discriminatory, or which otherwise violate/s any local or international laws.
vi. You attend a school and participate in a tour operated by Latitude Group Travel between September and October 2019.
vii. You read and agree to the terms and conditions.
viii. You do not breach the terms and conditions.
ix. You are not an employee or immediate family member of an employee of Latitude Group Travel
x. You must inform us if your personal information changes during the Promotion Period
xi. You consent to our privacy policy
xii. You grant Latitude Group Travel a worldwide, royalty free, perpetual, exclusive and irrevocable license to use your entry for any purpose
xiii. You unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of your moral rights, or present and future rights of a similar nature, conferred by law anywhere in the world whether occurring before or after this consent is given (“Moral Rights”).
xiv. You waive all Moral Rights that arise outside Australia
xv. You will not start, continue or support any claim or proceeding for infringement of your Moral Rights or Intellectual Property Rights.
xvi. You recognise that Latitude Group Travel is not responsible if a valid entry is not received whether this is caused by a system difficulty or malfunction or any other reason.
xvii. You acknowledge that Latitude Group Travel may, in its absolute discretion, disqualify an otherwise valid entry if, in our reasonable opinion, you have not complied with these terms and conditions or the entry process.
2. Contest Period:
The contest will commence at 9am AEST on Monday the 16th of September and end at 5pm AEST on Sunday the 27th of October 2019. All entries must be received during the Competition Period to be eligible to win a prize. Any entries not received during the Contest Period will not be eligible, and such entries will not be considered.
3. How to enter
i. Entrants may enter the Contest by taking and submitting one or more photographs showcasing you and your fellow participants experiencing your destination(s).
ii. Participation in the Contest is voluntary and does not require you to purchase anything from Latitude Group Travel.
iii. No illegible, incomplete or forged entries will be accepted.
iv. For clarity and without limitation, Latitude Group Travel may reproduce, modify, display and otherwise use the photographs for promotional purposes in any medium without any compensation due to you or anyone in the Photographs
v. Entrants may submit their Photographs by uploading their High-Resolution Submissions using the website www.latitudegrouptravel.com.au/studentphotocomp
4. By submitting photos to Latitude Group Travel, you confirm that for each photo submitted:
i. You are the only author of your work and that it is your original work
ii. You are the sole copyright holder
iii. You have not licensed any rights to the work that will conflict with the usage rights required by Latitude Group Travel
iv. You have permission from the owners of property shown in the work to grant the usage rights required by Latitude Group Travel
v. It does not include trademarks, contract rights, or any other intellectual property rights of any other third person or entity
You must not:
vi. Tamper with the entry mechanism.
You must not submit an entry that:
vii. Contains invalid, incomplete or inaccurate information.
viii. Contains defamatory, offensive, harassing, threatening or intimidating statements or messages.
ix. Invades the privacy or any other rights of any third party or
x. Breaks any law.
5. The rights of Latitude Group Travel
i. Latitude Group Travel reserves the right, in its sole discretion, to disqualify any entry that does not comply with any of the above, even after the entry is submitted on the competition website.
ii. Latitude Group Travel may collect your personal information, including, but not limited to, your name, likeness, email address, picture, school that you attend, address, phone number, tour that you travelled on etc. (“Personal Information”)
iii. Latitude Group Travel may select alternative winners to replace any subsequently disqualified winner, or a winner who does not claim their prize (“Alternate Winners”).
iv. All decisions made by Latitude Group Travel are final and no correspondence will be entered into.
6. Copyright Policy
Latitude Group Travel respects photographer’s rights and does not claim copyright over images submitted to this contest. You, the author, retain full copyright over each entry. Whenever your image is published by Latitude Group Travel you will be credited. Failure by Latitude Group Travel to publish a credit due to error or oversight shall not be deemed a breach of this condition.
7. Usage Rights
i. By entering this contest, you agree that images you submit may be used by Latitude Group Travel solely for marketing and promotional purposes of this contest, future contests or future marketing purposes.
ii. These images will not be returned to you. Please note that no image entries will be returned to any person who has submitted an entry
iii. Please note that students over 18 and parents or guardians for all students under the age of 18 have signed contracts for this tour with terms and conditions that include the following clause:
SHARING OF INFORMATION
Because our travel services are offered in conjunction with the services of the airlines and motor coaches etc, LGT may be sharing your personal information with those companies. We may share the following information: name, address, phone, birth date, gender, school you attend or teach at and/or email. LGT may capture the trip on film and digital images and use photos, videos and digital images for its marketing materials. LGT appreciates your participation in our photos, videos and evaluations, and LGT reserves the right to use these to advertise tour and passenger does not expect any compensation. Please notify us in writing if you do not want your image used.
This means that students over 18 and parents/guardians for students under 18 have released to Latitude Group Travel the right to use photos taken on the tour, which includes the photos taken for this competition. These photos may be used for the purposes listed in point 7 i) in this list. Parents/guardians must notify us specifically if you do not want photographs of your child used in this way, but those photos will then be disqualified from the competition.
8. Judging
i. The winners will be selected by Latitude Group Travel based on criteria set forth in the Contest Rules.
ii. The judging process will take up to a week from the deadline for entries
iii. The judges’ decision is final and they will not enter into communication relating to any entries or into how winning entries were decided
iv. Only selected entries will be exhibited on Latitude Group Travel social media when the competition is running and completed and this is at the sole discretion of Latitude Group Travel
v. The winner will be announced on Friday November 1, 2019 before 5pm AEST
vi. The winner will be notified by email and phone by 5pm AEST on Friday November 1, 2019 and the winner’s name will be published on the Latitude Group Travel website and Facebook page or other social media site such as LinkedIn, Twitter, Instagram or similar. All Entrants are encouraged to view these notifications which will also be made by 5pm AEST on 1 November, 2019.
9. Prizes
i. The prize for this competition is 1x GoPro Hero 7 White
ii. Although we endeavour to provide quality prizes, Latitude Group Travel cannot warrant sponsors product(s)/service(s) and you agree not to hold Latitude Group Travel, or its staff liable for any losses costs or liabilities that may arise in association with the prize
iii. Details relating to prizes will be sent to the winner via email within 7 days of the winner being announced.
iv. This prize is non-transferable and not redeemable for cash
v. PRIZES WILL BE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE).
vi. The prize is awarded subject to any terms and conditions of Latitude Group Travel or any third party providers to which the Prize Winner must agree to before accepting the prize.
vii. The prize is claimable up to 7 days after the winner has been notified of the prize.
viii. Latitude Group Travel may allocate the prize to an Alternate Winner if the first winner announced is unable to accept the prize for any reason.
ix. The prize listed here is substitutable for a prize of a similar value at Latitude Group Travel’s absolute discretion if, for any reason, the prize, or any element of the prize, is unavailable.
